> 朝鮮半島で女性を強制連行したと偽証した故吉田清治氏が韓国に建てた謝罪碑を無断で書き換えたとして、公用物損傷などの罪で在宅起訴された元自衛官、奥茂治被告(69)の判決公判が11日、大田(テジョン)地裁天安(チョナン)支部で開かれた。

On Jan. 11. a trial to hand down a verdict on Shigeharu Oku (69) -- former SDF member who was indicted without arrest for vandalizing a public matter and so on, as he refaced the Apology Monument being erected in South Korea (Cheonan-si, Chungcheongnam-do) by late Seiji Yoshida, who gave fake-testimonies to forcibly take females away in the Korean Peninsula -- was held at the Cheonan branch office of Daejeon District Court.
A judge delivered a judgment of a prison term of six months, suspended for two years (against the prosecution's demand for a one-year prison term), saying "it was intentional, and (Oku) planed the crime minutely."
> 奥被告は、碑の所有権は撤去を依頼した吉田氏の長男にあるとして犯意を否認していた。裁判官は、公的機関が使用する物件を損傷したかを問うものであり、仮に吉田氏の長男の所有であっても影響はないと指摘した。
> 一方、奥被告が自ら韓国の警察に出頭したことなどから情状を酌量した。
Oku denied any criminal intent, as ownership of the monument was possessed by the oldest son of Yoshida, who requested to remove the monument. The judge pointed out that what questioned was damaging a matter used by a public institution, therefore even if it was possessed by the oldest son, it didn't matter.
On the other hand, as defendant-Oku voluntarily appeared to the police in S. Korea and so on, it took the circumstances into account.
> 奥被告は判決後、記者団に控訴するかについて「吉田氏の碑文が嘘だということが判決文で認められているかを見て決めたい」と述べた。
> 奥被告が昨年6月に出頭してから出国禁止措置は約200日間に及んでいる。判決を受け、措置が解除される可能性が高いが、11日現在、解除は確認されていない。
After being sentensed, concerning he would apeal or not, defendant-Oku said reporters that "I intend to decide it after confirming whether it was recognzied ot not in the court ruling that inscription of Yoshida was fake."
Since Oku appeared in last June, exhibision to leave the country has been imposed on him for around 200 days. It is likely that the measure will be left following delivery of the sentense, but lifting has yet been confrirmed as of Jan. 11.

As being requested by the oldest son of Yoshida, who said "my father's fake-testimonies have blocked friendship between Japan and S. Korea," in last March, Oku pasted another stone plates on the Apology Monument being erected in the natinal graveyard (National Mang-Hyang Cemetery) in Cheonan-si (Chungcheongnam-do) in the central part of S. Korea -- refaced an apology words of "forcible taking away" to plain "memorial monument."

Though the oldest son of Yoshida was also prosecuted without arrest for the charge of criminal instigation, as he lives in Japan, in practice, the trial has been shelved.
